1. Agreement to Terms

By accessing or using Calendar Climate Keeper ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Calendar Climate Keeper is a web application that automatically activates your Tesla vehicle's climate control system before Google Calendar events. The Service includes:

• Integration with Google Calendar to monitor upcoming events
• Connection to Tesla vehicles for climate control
• Automatic climate activation based on travel time calculations
• Notification system for climate activation status
• Account management and subscription services

3. Subscription and Payment

• Subscription Fee: The Service requires a monthly subscription of $3.99
• Billing: Subscriptions are billed monthly in advance via Stripe
• Cancellation: You may cancel your subscription at any time through your account settings
• Refunds: Refunds are not provided for partial months, but you may continue using the service until your current billing period ends
• Price Changes: We reserve the right to change subscription prices with 30 days notice

4. Account Requirements

To use the Service, you must:

• Be at least 18 years old
• Own or have authorized access to a Tesla vehicle
• Have a valid Google account with calendar access
• Provide accurate account information
• Maintain the security of your account credentials
• Comply with Tesla's terms of service and API usage policies

5. Acceptable Use

You agree to:

• Use the Service only for its intended purpose
• Not attempt to reverse engineer or hack the Service
• Not share your account credentials with others
• Not use the Service to violate any laws or regulations
• Not interfere with the Service's operation or other users' experience
• Respect rate limits and usage guidelines set forth in our documentation

6. Tesla Integration and Vehicle Control

Important considerations regarding Tesla integration:

• Vehicle Access: You grant the Service permission to send climate control commands to your Tesla vehicle
• Battery Impact: Climate control activation may impact your vehicle's battery life
• Tesla API: Our service depends on Tesla's API, which may change or become unavailable without notice
• Vehicle Safety: You remain responsible for your vehicle's safety and operation at all times
• Third-Party Service: Tesla is not affiliated with or responsible for this Service

7. Service Availability and Limitations

• Uptime: We strive for high availability but cannot guarantee 100% uptime
• Dependencies: Service functionality depends on Google Calendar API and Tesla API availability
• Geographic Limitations: Service may not be available in all regions
• Vehicle Compatibility: Compatible with Tesla vehicles supporting climate control API
• Travel Time Logic: Climate activation may be limited to events with start times within a certain time window; longer trips may result in climate starting closer to departure than expected
• Maintenance: We may perform scheduled maintenance that temporarily affects service

8. Disclaimers and Limitation of Liability

Service provided "as is": The Service is provided without warranties of any kind, express or implied.

Limitation of liability: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Vehicle battery depletion or damage
• Missed calendar events due to service outage or scheduling logic
• Data loss or corruption
• Business interruption or lost profits
• Third-party service failures (Google, Tesla, Stripe)

Maximum liability: Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to:

• Session-based access tied to secure cookies
• Rate-limiting and activity monitoring for your protection
• Our use of push notifications, caching, and API integrations for performance optimization

10. Intellectual Property

The Service and its original content, features, and functionality are owned by Calendar Climate Keeper and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Arizona, United States, without regard to its conflict of law provisions.
